Following the sinking of the 1996 built bulk carrier ATLANTIK CONFIDENCE in March 2013, the Admiralty Court was asked to decide whether a guarantee could be used to establish a limitation fund in England under the 1976 Limitation Convention (as enacted by the Merchant Shipping Act 1995), or if the only means of doing so was by way of cash payment into court.
